What if closing is delayed or the transaction falls through?

Contact your account director promptly when a transaction changes. They will review the updated details and discuss the available next steps.

A delayed closing or failed transaction does not automatically change your payment date or cancel your obligations under the advance agreement.

If the closing date moves

Share the revised expected closing date, the reason for the change, and any updated documents or amendments. If the new date is uncertain, explain what is known and keep your account director informed.

Do not assume that a change to the escrow closing date automatically changes the payment date or other terms of your advance. Your signed agreement and any subsequent written amendments control those obligations.

How the 25-day grace period fits

Our current agreement provides a 25-day grace period following the stated closing date, during which no additional fees accrue.

The grace period does not remove the amount already due under your agreement. It addresses when additional fees begin to accrue. Your agreement and any subsequent written amendments govern the applicable dates and fees.

If the transaction falls through

A transaction falling through does not automatically cancel your obligations under the agreement.

Depending on the situation, options may include moving the advance to another existing transaction, arranging a self-pay payment plan, or exploring other ways to get back on track. Your account director will guide you through the available options and next steps.

These options require review. Do not assume that a replacement transaction or different payment arrangement has been approved until it is confirmed through the applicable documentation.

What to share with your account director

  • The property or transaction involved.
  • What changed and when you learned about it.
  • The revised expected closing or payment date, if known.
  • Relevant amendments, cancellation notices, or other updated documents.
  • Any change to the anticipated commission or payment contacts.
  • Information about another existing transaction you would like considered, if applicable.

Keep the parties coordinated

Follow your account director’s instructions for broker, escrow, title, or other payment coordination. Confirm any revised obligations in the applicable written documents, and retain copies for your records.
